FTC Suit Tests Line Between Clinical Guides and Consumer Ads

Seventeen states have warned that an FTC lawsuit against a transgender-health group could expose all medical societies to consumer-protection liability for their clinical recommendations.

The Federal Trade Commission and four states are suing the World Professional Association for Transgender Health (WPATH), alleging its standards of care for gender-affirming medicine contain false or misleading claims that induce patients to purchase services, violating federal and state consumer protection laws. In an amicus brief accepted by the Northern District of Texas, 17 other states and the District of Columbia argue the FTC's novel legal theory improperly recasts professional medical guidance as commercial advertising.

This case is significant for any organization that develops or relies on clinical guidelines. If courts accept the FTC’s premise—that issuing standards for services provided by an association’s members constitutes a commercial inducement—it could expose a vast range of professional societies in fields like cardiology, oncology, and pediatrics to similar liability. The amici warn this would intrude on the states' traditional authority to regulate medical practice and could chill the development of essential clinical guidance. The suit differs from other recent federal actions on this topic by targeting the guideline-development process itself, rather than providers or reimbursement.

WPATH must now respond to an amended complaint. Counsel for professional societies, healthcare providers, and life sciences companies should monitor the court's forthcoming decisions on whether clinical guidance can constitute actionable advertising.
