CMS Finalizes Mandatory MFN Drug Pricing Model for Medicare Part B
CMS has finalized the GLOBE Model, making Most Favored Nation-based pricing binding for Medicare Part B drugs and reshaping launch pricing, rebate and contracting strategy for manufacturers and their advisers.
On September 30, 2026, the Centers for Medicare & Medicaid Services finalized its rule implementing the Global Benchmark for Efficient Drug Pricing (GLOBE), a mandatory Most Favored Nation (MFN) drug pricing model for Medicare Part B. Until now, MFN pricing has existed only in voluntary demonstration models; a final rule converts the concept into a binding coverage and payment framework for Part B drugs, benchmarking U.S. prices against prices in comparable countries.
Why sophisticated counsel and clients should care: MFN benchmarking compresses the price differential manufacturers have relied on when setting U.S. launch and list prices for Part B products, including high-cost biologics, oncology infusions, and some gene and cell therapies. That directly affects gross-to-net economics, discount and rebate structures, PBM and distributor contracting, international reference-pricing strategy, and the calculus of accelerated approval filings versus staged launches. It also raises statutory and administrative-law questions ahead of likely litigation, and may ripple into Medicaid and commercial formulary negotiations.
Concrete action and what to watch: counsel should map Part B portfolio exposure to the final GLOBE methodology, review or renegotiate distribution and rebate agreements, and reassess launch-timing decisions. Watch for the rule's Federal Register publication, effective date and phase-in, implementing guidance, and early legal challenges.
