OFAC Widens Iran Sanctions to Aviation, Auto and Rail Supply Chains
OFAC's Operation Economic Outcast reportedly designates Iranian aviation, automotive and rail entities plus their foreign suppliers, exposing non-US counterparties to secondary liability risk.
According to a Morgan Lewis alert, the US Treasury Department's OFAC has escalated a campaign it calls Operation Economic Outcast against Iran, adding designations across the aviation, automotive and rail sectors and, critically, reaching the foreign suppliers of those sectors. The supplier-facing element is what sophisticated compliance teams should note: designations of non-US entities that supply designated Iranian industrial targets can pull banks, freight forwarders, insurers and equipment vendors into secondary liability exposure even where they have no US nexus beyond dollar clearing or correspondent relationships.
For major-firm clients in aerospace, automotive, shipping and industrial manufacturing, the practical consequence is immediate. Existing onboarding files for Iranian-origin or Iranian-end-use transactions need re-screening against the expanded list, and payment rails touching designated persons must be frozen or risk-frozen pending licences. Counsel should also expect counterparties to seek contractual sanctions indemnities, and should expect designations and any clarifying OFAC guidance to be applied with retrospective force to conduct predating the listing, which is why transaction-specific advice matters more than a general policy refresh.
Evidence here rests on a single law-firm alert; the specific designated entities, the legal authorities invoked and any carve-outs or licence generalisations should be confirmed against the Federal Register notices and OFAC's own FAQs before client reliance.
