California Enacts Sweeping AI Workplace and Legal-Practice Bills

Gov. Newsom signed a package of California bills regulating AI in the workplace and in legal practice, prompting employers and law firms alike to audit policies and vendor tools.

According to a Davis Wright Tremaine client alert, California Governor Gavin Newsom has signed a package of bills described as among the most comprehensive state-level efforts in the country to regulate artificial intelligence, covering both AI in the workplace and AI used in the delivery of legal practice.

Why sophisticated counsel should care: California is the largest employer base in the country and has now moved from a patchwork of existing AI statutes and labor authorities' guidance to codified statutory rules. Obligations attaching to employer use of automated decision tools and separate constraints on lawyers' own reliance on AI sit in the same legislative package. Employment agreements, internal acceptable-use policies, HR data practices and vendor contract language touching AI tools may all need review. Multi-state employers face added divergence between California and other states' regimes.

Concrete next steps: inventory AI systems used in California-affected operations and legal workflows; map which obligations attach to each deployment; confirm effective dates and any notice, recordkeeping or disclosure requirements; and reassess vendor representations. Watch for implementing regulations, agency guidance and litigation testing the provisions — the alert does not enumerate specific bill numbers, deadlines or obligations, so details should be verified against the enacted text.
