TTAB Reexamines and Cancels EVERWISE CREDIT UNION Mark Over Token Use

The TTAB’s latest ruling declares token-like names insufficiently distinctive, invalidating the Everwise Credit Union brand.

The U.S. Trademark Trial and Appeal Board (TTAB) has issued a landmark reexamination decision that cancels the ever-worn mark ‘EVERWISE CREDIT UNION’ after finding its token-like construction fails to provide distinctiveness. The ruling follows a decade-long dispute in which the mark was initially refused as descriptive. By declaring the term lacking in secondary meaning, the TTAB effectively removes federal trademark protection for the name. This decision sends a clear signal to firms and clients that token-based or generic-sounding marks—particularly those that resemble other terms—are at risk of being deemed non‑protectable even if previously registered. Counsel should review current client portfolios for similar token-laden identifiers, advise on the feasibility of alternative trademarks, and monitor any appeal filings that may contest the TTAB’s findings at the appeals court or the Supreme Court.
